Idioma/Language: Español. teoría Si un caso individual se subsume sin dificultad en una norma legislativa y solo en ella, es clara la consecuencia jurídica, aplicarla coincide con la presunta voluntad legislativa y es razonablemente "coherente" con la jurisprudencia dominante y una extensión relevante de valores explícitos o subyacentes del ordenamiento, especialmente de la rama del derecho en cuestión, entonces difícilmente pueda decirse que existe un problema interpretativo. Esta situación, sin embargo, no es tan frecuente como desearíamos, lo cual da lugar, en la práctica, a intervenciones judiciales que no se reducen a la mera interpretación objetiva o estricta de un texto legislativo. La función de los métodos de interpretación es establecer límites a la libertad de los jueces en la administración de justicia. Pero esos límites serían prácticamente inexistentes si hubiera discrecionalidad en su elección; sobre todo cuando, como se suele verificar, son numerosos. La pregunta que se impone, entonces, es: ¿existe esa discrecionalidad, o hay una suerte de jerarquía entre esos métodos?
