Hardcover. Condition: Very Good. Dust Jacket Condition: Very Good. First Edition. BY1 - A first edition (complete numberline) hardcover book SIGNED and inscribed by author to previous owner on the front free endpaper in very good condition in very good dust jacket. Dust jacket and book have some bumped corners, light discoloration and shelf wear. 8.5"x5.75", 248 pages. Satisfaction Guaranteed. Even as important elements of constitutional practice in the United States - with a robust and independent constitutional judiciary acting in the name of a written and durable founding document - are being embraced by nations everywhere, those very elements are under attack at home. Politicians and scholars alike charge that it is undemocratic to leave fundamental political choices in the hands of judges. In this important book, Lawrence Sager, a leading constitutional theorist, offers a lucid understanding and compelling defense of American constitutional practice. Sager treats judges as active partners in the enterprise of securing the fundamentals of political justice, and sees the process of constitutional adjudication as a promising and distinctly democratic addition to that enterprise. But his embrace of the constitutional judiciary is not unqualified. Judges in Sager's view should and do stop short of enforcing the whole of the Constitution; and the Supreme Court should welcome rather than condemn the efforts of Congress to pick up the slack. Among the surprising fruit of this justice-seeking account of American constitutional practice are a persuasive case for the constitutional right to secure a materially decent life and sympathy for the obduracy of the Constitution to amendment. No book can end debate in this conceptually tumultuous area; but Justice in Plainclothes is likely to help shape the ongoing debate for years to come. Size: 8vo - over 7¾" - 9¾" tall. Signed by Author.

Hardcover. Condition: Very Good. Dust Jacket Condition: Very Good. First Edition. AU6 - A first edition (no additional printings) hardcover book SIGNED by Larry Sager and inscribed to previous owner on the half-title page in very good condition in very good dust jacket. Dust jacket has some wrinkling and chipping on the edges, light discoloration and shelf wear. Book has some bumped corners, a few stains on the page edges, light discoloration and shelf wear. 8.5"x6", 333 pages. Satisfaction Guaranteed. Religion has become a charged token in a politics of division. In disputes about faith-based social services, public money for religious schools, the Pledge of Allegiance, Ten Commandments monuments, the theory of evolution, and many other topics, angry contestation threatens to displace America's historic commitment to religious freedom. Part of the problem, the authors argue, is that constitutional analysis of religious freedom has been hobbled by the idea of "a wall of separation" between church and state. That metaphor has been understood to demand that religion be treated far better than other concerns in some contexts, and far worse in others. Sometimes it seems to insist on both contrary forms of treatment simultaneously. Missing has been concern for the fair and equal treatment of religion. In response, the authors offer an understanding of religious freedom called Equal Liberty. Equal Liberty is guided by two principles. First, no one within the reach of the Constitution ought to be devalued on account of the spiritual foundation of their commitments. Second, all persons should enjoy broad rights of free speech, personal autonomy, associative freedom, and private property. Together, these principles are generous and fair to a wide range of religious beliefs and practices. With Equal Liberty as their guide, the authors offer practical, moderate, and appealing terms for the settlement of many hot-button issues that have plunged religious freedom into controversy. Their book calls Americans back to the project of finding fair terms of cooperation for a religiously diverse people, and it offers a valuable set of tools for working toward that end. Size: 8vo - over 7¾" - 9¾" tall. Signed by Author.
