Es galt die Rechtsdogmatik des Ius Romanum im damals geltenden Recht herauszuarbeiten. Die Rechtsquellendarstellung war im Prinzip rechtsvergleichende Arbeit. Aber auch die Frage der Rechtsgeltung bei verschiedenen Rechtsquellen, also die Kollision der Gesetze, war Gegenstand der Arbeit. Nach dem damaligen Kenntnisstand wird diese Frage an die Statutentheorie gerichtet: Quando praefareantur Juris Romani. In seiner einleitenden Abhandlung: De Usu et Auctoritate Juris Romani in Fori Germaniae, die dem Band 1 und der Erörterung der ersten Lex der Digesten vorangestellt ist diese Problematik der rote Faden, der sich durch die ganze Abhandlung zieht. Nachdem er unter Georg Kaspar Kirchmaier mit de auro obryzo & agento pusulato disputiert hatte, kehrte er 1688 zu seinem Vater nach Frankfurt an der Oder zurück. Dort widmete er sich vornehmlich bei seinem Vater den Rechtswissenschaften. Als dieser nach Wittenberg ging, folgte er ihm und war dort der erste Responent, der unter seinem Vater mit dissensu sponsalito disputierte. Nachdem er 1691 unter die juristischen Kandidaten aufgenommen war, absolvierte er eine Bildungsreise, die ihn an die Universität Groningen, die Universität Franeker, die Universität Leiden, die Universität Utrecht und die Alte Universität Duisburg führte. Dort hatte er sich mit den Gelehrten seiner Zeit bekannt gemacht. // Auszug aus WIKISOURCE: "Stryk s wissenschaftliche Bedeutung beruht namentlich darauf, daß er die Thätigkeit eines Lauterbach, eines Struv fortsetzt, wie sie in der Feststellung des in Deutschland thatsächlich geltenden gemeinen Civilrechts, der praxis moderna des Römischen Rechts bestand, zugleich aber den neueren Strömungen des beginnenden 18. Jahrhunderts ihr Recht widerfahren läßt und so vermittelnd wirkt. Namentlich geschieht dies in seinem Hauptwerk, dem Usus modernus Pandectarum", dessen erste Titel 1690, dessen letzte Bände erst 1712 aus Stryk s Nachlaß von seinem Sohne veröffentlicht worden sind (10. und letzte Ausg., in 4 Bdn., Halle 1746 1780). Nicht Vollständigkeit wird hier beabsichtigt, namentlich nicht etwa, wie bei Lauterbach, jede Materie nach allen ihren Beziehungen an der Hand eines festen Schemas abgehandelt, sondern es werden bei jedem Titel praktisch besonders wichtige Einzelfragen herausgegriffen und lediglich nach dem Vorgange und den Bedürfnissen der Praxis beantwortet. Aber eines tritt hier denn doch neu zur Praxis hinzu: eine starke Berücksichtigung deutscher Rechtsquellen, sowol älterer allgemeiner, nämlich der Spiegel, wie jüngerer territorialer Gesetzgebungen, deren eine nicht ganz unerhebliche Anzahl vorkommen. Diese Verbindung des alten Verfahrens mit dem neuen, germanistischen Geiste, etwa eines Schilter, entspricht genau den im Discursus praeliminaris" entwickelten Grundsätzen; auch sie suchen einen gewissen Mittelweg, indem einerseits die präsumptive Gültigkeit des Römischen Rechts in Deutschland strenge festgehalten, andererseits aber der Vorzug des in seiner Selbständigkeit anerkannten, aus seinem Sinn hervor zu interpretirenden Deutschen Rechts, wo solches nachweisbar, anerkannt wird. Vor und neben diesem Usus modernus hat St. eine Reihe von Monographien veröffentlicht. Sein erstes derartiges Werk ist das De jure sensuum" (Frankfurt, zuerst 1665, dann erweitert 1671); hier werden alle Rechtseinrichtungen und -Fragen, welche an die einzelnen Sinne anknü.
