L'enfant vraiment légitime est, toujours et uniquement, celui qui est conçu des oeuvres de deux individus mariés au moment de la conception. Donc, pour savoir si un enfant qui arrive au monde est ou non légitime, il y aurait trois choses à faire 1° rechercher l'ê poque de la conception; 2° regarder si à cette époque la mère qui vient d'accoucher était mariée; 3° voir si celui qui alors était son mari est bien le père de l'enfant. Or, de ces trois choses, il en est deux que la nature nous met dans l'impossibilité de connaître avec certitude; car s'il est facile de savoir que telle femme est accouchée de tel enfant et que cette femme était mariée à telle époque, il ne nous est pas donne de savoir à quelle époque précise cet enfant a été conçu, que! Homme l'a engendré. C'étaient donc de simples présomptions qu'il fallait ici ériger en règles. C'est ce que fait notre article.
