The manuscript account of the arguments in the case of Bolling v. Bolling (chiefly in the hand of Thomas Jefferson) is now published for the first time. It is the most complete account known of arguments submitted to an American colonial court. The case deals with issues of property and inheritance law that arose out of the will of Edward Bolling, a member of a prominent Virginia family who died in 1769. The parties were his brothers. George Wyth (the greatest legal mind of the time) represented Archibald Bolling, the plaintiff; and Thomas Jefferson (who had been Wythe's best student) represented Robert Bolling, the executor and defendant. No other case of the period so effectively demonstrates the legal learning and skill of colonial American lawyers. In his introduction, Professor Schwartz places the manuscript in legal context, discussing law and the legal profession in pre-Revolutionary America, legal education (particularly Jefferson's), and Jefferson as a lawyer. Thomas Jefferson and Bolling v. Bolling is a highly recommended addition to all Jeffersonian collections and Colonial American history reading lists. -- Midwest Book Review
