Requirements of appeal based on evidentiary ruling: i. 103(a) error must affect a substantial right (outcome of the trial will have been different if the evidence had not been excluded or admitted) ii. 103(a)(1) Must have protected the record - there must be evidence on the record of your objection: 1. Formal Objection: objection to the form of the questions, the way the Q is asked, not objecting that it violates some substantive rule of evidence. 2.
