Excerpt from The Arguments of Counsel for Libellee, Helen Maria Dalton, in the Dalton Divorce Case: Consisting of the Opening Address of H. F. Durant, Esq., And the Closing Plea of Hon. Rufus Choate
With regard to the propriety of the mode in which jus tice is administered in our country, by open trial, ex posed to the aze of the public, people may differ as they will. E have been accustomed to believe here, gentlemen, that whatever the details of a trial may be, it is better that all trials should be open and free; that there should be nothing in the conduct of the parties, of the counsel, of the jury, which is not Open to the public gaze, rather than submit to a system of secret tribunals, such as has prevailed in other countries. On this point people may judge, and differ as they please; it is enough that our system is a system of free and open trial.
