The unifying premise of the literature on law and social norms is, to quote Posner (law, U. of Chicago), "the conviction that forms of order, including cooperation, exist without government enforcement, and that the existence of these forms of order poses problems and opportunities for formal legal regulation." In putting together this retrospective of the field, he favored earlier and more influential articles and those that have direct application to the law (as opposed to much of the work done by economists) and avoided works with heavy formalized modeling. His sixteen selections are grouped into sections covering general theories, norms and efficiency, business custom, judicial applications, and empirical and historical work. Book Description Edward Elgar Publishing Ltd, United Kingdom, 2007. Hardback. Condition: New. 4th ed.. Language: English . Brand New Book. This authoritative collection brings together a careful selection of previously published articles that use economics to analyze the interaction of law, on the one hand, and social norms and nonlegal sanctions on the other. The articles cover a range of foundational questions. What are social norms and nonlegal sanctions? Do strong laws undermine social norms, thus weakening other valuable forms of social cooperation? Can laws be used to exploit existing social norms, so that the laws are more effective than they would be otherwise? The contributing authors use a variety of economic models and concepts to address these questions. Seller Inventory # AAJ9781845424954
