About this title:

Synopsis: Five papers discussing the recent developments as to international dispute resolution of civil and commercial matters were presented at the Workshop on the Evolution of Party Autonomy in International Civil Disputes held in June 2004. This book contains the revised versions of these five papers written by Singaporean and Japanese professors. Generally it is believed there are a lot of differences between the legal system of Japan and that of Singapore, i.e., the civil law system and the common law system. However, the authors undertook a comparative law approach and revealed the existence of one important area where both systems of private international law are beginning to show the same tendency: international commercial dispute resolution, the respect of party autonomy. This publication aims to propose a new approach to private international law. It is hoped that the publication will be useful to law scholars and students, as well as lawyers, judges, legislators and government officials, who are interested in the development of private international law.
