In 1917 the House of Lords considered in the case of R. v. Halliday an appeal against a regulation for internment under the Defence of the Realm Act. The appellant claimed that the regulation if valid gave the Government of the day power to deprive men of their liberty at whim and to imprison them without trial and without opportunity of being heard in their defence. It was claimed that these things were contrary to the provisions of Magna Charta and all the Acts since passed to preserve the liberties for which the people of England fought and which they had won from the Crown and autocratic Governments under the Crown. For those concerned with liberty in a parliamentary democracy the ironic words of Lord Shaw of Dunfermline ring down the years. He dissented from the majority who held the regulation to be valid...Car Zoeller was such a victim of a similar Australian regulation. Whilst interned he wrote a letter criticising those responsible for his internment. Those same people then used that letter in extracted form to effect his denaturalisation and subsequent deportation from Australia.
