About this Item

Previous information lacking, due to a large piece torn from the bottom of the title page. Pamphlet. 27 pp. A printing of the opinion of the Chief Justice of the New Hampshire Superior Court, William M. Richardson, finding for the defendant, William H. Woodward. An important case in American legal history, one that was eventually argued before the United States Supreme Court, with the eventual ruling for the plaintiff, the trustees of Dartmouth College. The Trustees were represented by Daniel Webster (in the Supreme Court Case) and were able to have their original college charter upheld, despite legislation passed by the state of New Hampshire that gave New Hampshire the right to supercede the sanctity of the original charter. The Supreme Court, led by John Marshall found in favor of Dartmouth, with historians arguing that this ruling strengthened the Contract Clause and limited state power in interfering with private charters, paving the way for the growth and strengthening of private corporations (wikipedia). With an ink inscription on the top of the title/front page reading, 'Essex Historical Society from Jacob B. Moore, of Concord, NH.' Moore was a publisher in Concord, New Hampshire and appears to have corresponded, perhaps briefly, with Daniel Webster, on political affairs in the 1830's (online library archives). FAIR condition, MISSING a roughly 4 by 4 inch piece from the lower title page, unevenly and somewhat jaggedly torn away, resulting in the loss of printer and place/date information. Heavy browning to the exterior pages, with lighter browning and offsetting to the paper in the interior. A few pages with heavy browning along the extremities. First page with heavy browning corresponding with the missing section of the front page. Several pages unopened. Minor chipping, tearing, creasing and curling along the bottom and fore edge. Several small old tape repairs in the margins of a few pages. Sabin 18623. Bookseller Inventory # 006017
