Prescott was a Judge of Probate of the County of Middlesex. These are the proceedings of the Senate and House of Representatives of the Commonwealth of Massachusetts relative to the his impeachment on the charges of misconduct and mal-administration of his office. Originally Pickering and Gardiner intended to provide serial accounts of the trial to the Boston Daily Advertiser, which ultimately published it. Once the trial began, the writers, who were also both attorneys, decided to publish the full report instead. "The arguments of the counsel will be found to contain much valuable information on the subjects of impeachment and courts of probate, and the appendix, if it does not supersede the necessity of sometimes recurring to the journals of the Legislature for the records of former impeachments, will at least serve as an index to them."
