As devices for the long-term, built-in control of land, easements, covenants and servitude are so overlaid with historic mumble that lawyers have often been uncertain whether the device in hand is one or the other, all or neither. Treating the law of easements, profits and covenants as an integrated body of doctrine, this Restatement eliminates needless distinctions, old terminology and obsolete requirements. With the increasing use of restrictive devices in real estate development (subdivisions, condominiums, business parks, etc.) the need is apparent for a unified exposition of the law of servitude. It is designed to allow both traditional and innovative land development practices using servitude without imposing artificial or arbitrary limitations of either form or substance.
