Contemporary vellum, early vellum rebacking with hand-lettered title. Some rubbing to extremities, a few small stains to boards, vellum just beginning to break through pastedowns, hinges cracked, a few partial cracks to text block (binding still secure). Later small owner signature to front endleaf, another to title page. Occasional faint dampstaining to margins, interior otherwise fresh. $600. * Later edition. First published in 1548, this is a critical edition of D'Afflito's Tractatus De Jure Protomeseos (1544), an edition of a work on preemption in feudal law by Baldus de Ubaldus with commentary. Afflito was an Italian jurist and state official. A pupil of Bartolus, Baldus de Ubaldis was a prominent commentator and professor at the Universities of Perugia and Padua. De Afflict." (come risulta dal nome in bs. a sn.), capilett. incisi e ill., indice con il primo capilettera inciso e istoriato e gli altri grandi e in neretto, marca tip. in fine (fontana zampillante a forma di anfora con in cima una donna e intorno teste di puttini sostenute da satiri; sulla seguente c. b. si riflette, chiaramente inchiostrata, questa marca; sull’ultima c. b. si riflette invece, chiaramente inchiostrata, la marca iniziale con il testo del front.), leg. orig. in p. perg. floscia con tit. ms. lungo il dorso, unghie, tracce di laccetti (mancanti). Trattazione giuridica primamente impressa nel 1539 e ristampata fino al 1699 e oltre (la data della prima edizione è tarda, ma si riferisce forse alla prima comparsa dei due Autori insieme, poiché il "De Jure Prothomiseos" del D’Afflitto ci risulta essere uscito per la prima volta a Venezia presso Bernardinus de Vitalibus per Alovisius & Franciscus de Rubeis il 27 luglio 1499). Gli autori: Matteo (o Mazzeo) D’Afflitto ("il Giovane") (Napoli, 1448 ca. (secondo il Savigny) o 1443 (secondo il Novissimo Digesto Italiano) – Napoli, 1528 ca. (o 1523 secondo alcune fonti), discendente di una delle più antiche famiglie di Amalfi, giureconsulto feudista, fu chiamato a leggere diritto civile, canonico e feudale nell’Università di Napoli e fu presidente della Regia Camera della Sommaria verso il 1491. Fu celebre e valente giureconsulto, soprattutto nel diritto feudale e con le sue numerose opere concorse potentemente al rinnovamento della cultura giuridica del Sud Italia tra Quattro e Cinquecento. Fu anche autore del "Consiliarius Principium et Ufficialibus Eligendis ad Justitiam Regendam", oltre che di questo "De Jure Prothomiseos", senza considerare vari altri testi minori. Compose l’officio, approvato dalla Chiesa, della translazione del corpo di San Gennaro e fu Consigliere del Re Ferdinando I. Baldo degli Ubaldi (Perugia, 1327 ca. – Pavia, 1400 o 1406), fratello di Angelo degli Ubaldi e discepolo di Bartolo da Sassoferrato, fu giureconsulto e professore a Pisa, Perugia e Padova. Pergamena fittamente manoscritta per mano antica ai contropiatti, sporco al margine inferiore del frontespizio e al taglio inferiore, nome di appartenenza al front. piccola mancanza della pergamena al dorso, normali segni di sgualcitura, antiche, rare sottolineature nel testo.
