Sm 4to. 31 pp. Text of the U.S. Supreme Court decision that ended Richard Nixon?s presidency. The landmark case addressed the extent of presidential privilege in the face of a subpoena for tapes and other materials relevant to a criminal trial. Oral Arguments were made on July 3, 1974 and the unanimous Burger Court Opinion [with Justice William Rehnquist not taking part due to a prior role in the Nixon administration] ruled against the President. Chief Justice Warren Burger said that the President didn?t have an absolute, unqualified privilege to withhold information. The Opinion was announced on July 24, 1974. The Court determined that while the principle of executive privilege exists, it cannot be absolute and unqualified. The Court also found that a claim of Presidential privilege could not override the needs of the judicial process, especially when the claim is not based on military or diplomatic secrets but on a generalized interest in confidentiality.
