Dabei wird zunächst die RStPO in der Weimarer Republik und die historische und politische Situation Deutschlands vor der Machtübernahme der Nationalsozialisten beschrieben. Im weiteren Verlauf werden die Ideologie, die politischen und gesellschaftlichen Ziele sowie die nationalsozialistische 'Weltanschauung' und die daraus resultierende strafverfahrensrechtliche Vorstellung ausgeführt. Im zweiten Teil werdendie konkreten und diskutierten strafrechtlichen Reformen im historischen Kontext ausführlich behandelt und zum Ergebnis Stellung bezogen. Zum Schluß werden einige strafverfahrensrechtliche Vorschriften aus dieser Zeit mit der Nachkriegs- bzw. heutigen StPO verglichen. Die Entstehung der RStPO von 1877 ist wie andere Rechtsvorschriften aus dieser Zeit (StGB von 1870 und die 1879 in Kraft getretenen Reichsjustizgesetze und schließlich das BGB imJahre 1900), als Produkt der Aufklärung, der Erkenntnis der Gleichheit aller Menschen und des immer mehr aufkommenden Individualismus, Liberalismus und des demokratischen Bürgerstaates zu verstehen. Allen Vorschriften gemein ist, daß der einzelne Bürger als Subjekt in das Zentrum der rechtlichen Betrachtung rückt. Zwar sind die einzelnen Grundrechte der Bürger zur Abwehr gegen den Staat noch nicht verfassungsrechtlich aber doch einzelgesetzlich garantiert. Neben dem zivilrechtlichen Anspruchsaufbau mit dem Ziel des Ausgleichs zwischen den Parteien, ist der Beschuldigte im Strafverfahren nicht nur Objekt derRechtsvorschriften, sondern erhält Rechtsgarantien gegen den Staat. Kennzeichnend für die RStPO, die in ihrer Grundstruktur und ihrem wesentlichen Inhalt nach der heutigen StPO entspricht, waren das Offizialprinzip, das das Einleiten und Betreiben des Strafverfahrens von Amts wegen sicherstellt, die Instruktionsmaxime als selbständige, antragsungebundene von Amts wegen durchzuführende Sachverhaltsaufklärung, dasAkkusationsprinzip, das die Identität von Ankläger und Richter beseitigte und damit sicherstellt, daß nur die in der Anklage der Staatsanwaltschaft bezeichnete Tat Gegenstand der gerichtlichen Urteilsfindung sein kann.
