Based on travels of Captain William Drummond Stewart, a Scottish nobleman who would inherit the title of seventh baronet of Murthly Castle in 1838, who took sporting trips to the U.S. in 1832, 1838 and 1842, ACCOMPANIED BY THE CELEBRATED ARTIST ALFRED JACOB MILLER (1810-1874). Miller was the first Anglo-American painter to travel as far west as the Rocky Mountains, and the only one to paint a comprehensive view of the Rocky Mountain fur trade. Stewart came to America on pay from the British Army in 1832 and traveled west to the Rockies where he remained for several years. While in New Orleans during the winter of 1836-1837 he met Alfred Jacob Miller, and invited him to accompany him on his next journey to record scenes of his adventures. "Miller departed from St. Louis with Stewart's party in May 1837. Their destination was the fur trade rendezvous, a meeting held each year between eastern traders, Indians, and Rocky Mountain trappers. The 1837 rendezvous took place at Horse Creek, a tributary of the Green River, near the present-day border of Colorado and Wyoming. The party went from St. Louis to Westport and then traveled northwest along the Kansas River to the Platte, passing such landmarks as Scott's Bluff and Chimney Rock on their way to Fort Laramie. From Fort Laramie they continued west through the South Pass and north to the rendezvous. After the rendezvous, Stewart and his band headed into the Wind River Mountains to the source of the Green River. There they spent their time hunting before returning to St. Louis in the fall of 1837. "Miller returned to New Orleans shortly thereafter and began work on eighty-seven wash and watercolor drawings and several oil paintings for Stewart that were based on sketches he made in the field. Miller is best known for his western subjects, which include sketches produced in the field along with finished oil-on-canvas and watercolor paintings made for Stewart. Although Miller's early works are undated, it is likely he completed as many as 150 sketches in the field. Most of these are executed in watercolor or wash over pencil with gouache on a variety of papers and are small in size. In the years following his return from Scotland, Miller continued to produce versions of these initial sketches in oil and watercolor. More than half of Miller's paintings show Shoshone, Sioux, and Nez Percé engaged in a variety of activities: caring for children, preparing meat, sewing, chasing horses, or hunting. Miller also painted scenes of the caravan en route and of trappers at the rendezvous, along with mountain landscapes. Many of the earlier works show Stewart hunting or visiting Shoshone camps. Whereas William of Orange supported repealing the Penal Laws, but opposed the repeal of the Test Acts, his predecessor James sought to repeal the Penal Laws AND the Test Acts, thereby allowing Catholics the right to hold public office. This is the rare first Edinburgh edition; ESTC lists only BL and NLS in the United Kingdom, and Huntington and Univ. of Illinois in the United States. James Stewart (1635-1713) was one of the leading Scottish radicals in the revolutionary movement. He was offered a pardon by James II, in return for which he sought to persuade his colleagues to return from exile in Holland. In the present pamphlet Stewart replies to a letter written by Gaspar Fagel (1634-1688) describing William's position on the repeal of the Penal Laws, the repeal of the Test Acts, and of religious toleration ("Letter writ by Mijn Heer Fagel, pensioner of Holland, to Mr. James Stewart, advocate"). "Fagel's letter provoked numerous replies and defences, and clearly established the international framework for the debate on toleration. The radical exiles in Holland, who were divided among themselves on the issue of support for, or opposition to, James' toleration policy, were placed directly in the midst of a propaganda and power struggle between James II and William, and ultimately between England and Holland. In very concrete and practical terms, the exiles' position on the issue of toleration was tied to their willingness to accept a pardon from James and return to Britain, as an endorsement of Stewart's claim that all was well there, or to remain in Holland and continue their fight against James, counting on the support and encouragement of William" (SOURCE: Richard Ashcraft, "Revolutionary Politics and Locke's Two Treatises of Government" p. 486). The first staple contract, which set out the privileges to be enjoyed by Scottish traders, was drawn up in 1541. The introduction of the work is an historical account of the staple written by Charles Stewart, who was at that time the deputy conservator at London. The main text is written by James Yair, a minister of the Scottish Church in Veere (Campvere). Veere was Scotland's staple port from 1541 until 1799. Scottish merchants could export certain goods such as wool, coal, tiles, arms and ammunition to Veere without paying customs. Veere was a prosperous trading city during the 17th and 18th centuries.With the armorial book plate John Whitefoord Mackenzie (1794-1884), whose library was auctioned in 1886. Also with a small faint library stamp of the Solicitors Supreme Court on the foot of the title-page. With a few spots, otherwise in very good condition. Small quarto sized magazine, original wrappers with text in black to front and back and colour Nolan illustration to front wrapper. Chips to corners with some loss to wrappers at spine ends, split to rear wrapper repaired, red stain to rear wrapper, a good copy. First edition, in the very scarce original Angry Penguins issue, of the poems that constituted one of the great literary hoaxes of the century. Ern Malley's Darkening Ecliptic made its first appearance in this special commemorative Autumn 1944 number (actually June) of Angry Penguins, Australia's leading modernist literary magazine, who had had the poems submitted to their offices with a cover letter by an Ethel Malley, claiming to have found them in the effects of her recently deceased brother, Ern Malley. Angry Penguins took the bait beautifully, and published the poems with a portentous introduction by editor opening: "Ern Malley prepared for his death quietly confident that he was a great poet, and that he would be known as such." In fact, there was no Ethel nor any Ern, but two poets, James McAuley (1917-1976) and Harold Stewart (1916-1995), who wished to pull the leg of a literary establishment they saw as pretentious and misled. The hoax was quickly exposed in the Sydney Sunday Sun, and McAuley and Stewart made a tart statement exposing themselves as the authors and justifying the fraud: "What we wished to find out was can those who write and those who so lavishly praise this kind of writing, tell the real product from consciously and deliberately concocted nonsense." In this McAuley and Stewart's hoax appeared to have been an unqualified success, and by 1946 Angry Penguins had folded, utterly discredited. The Oxford Companion to Australian Literature observes that "the vigorous and legitimate movement for modernism in Australian writing received a severe setback, and the conservative element was undoubtedly strengthened." The longer-term effect of The Darkening Ecliptic, however, has been more subtle and ironic. In time poets such as John Ashbery, Kenneth Koch and Robert Hughes began to celebrate the poems as a successful example of surrealist poetry. Hughes claimed that Malley's "creation proved the validity of surrealist procedures: that in letting down their guard, opening themselves to free association and chance, McAuley and Stewart had reached inspiration by the side-door of parody". Certainly Malley's poems are still today far more widely read than those of his creators. Moreover, much genuine art and poetry was generated in response, knowing or otherwise, to Malley's potent gibberish, in particular artist Sidney Nolan's iconic Ned Kelly series (1946-7). Nolan later claimed that The Darkening Ecliptic "made me take the risk of putting against the Australian bush an utterly strange object". Original copies of this Darkening Ecliptic issue of Angry Penguins are very scarce. The rarity is in part due to the impounding of many copies by the police as the result of the obscenity trial which Harris, in addition to the crucifixion of his literary credibility, was forced to endure. This copy has a contemporary news clipping relating the story of the hoax laid in, concluding: "To Lieut. James McAley and Cpl. Harold Stewart, joint debunkers of Bosh and Blah and Blather, earnest thanks!". Seller Inventory # 123632
