Dissertation Utrecht University. - This study revolves around the issue of the participation of juvenile defendants in the youth court. Juvenile defendants' right to be heard, as stipulated in international children's rights law and standards, and the fact that juveniles have a limited understanding of the juvenile justice process are taken as starting points to formulate directives in order for young persons to be able to participate effectively in the youth court. [-][-]In total, the cases of 3,019 juvenile defendants have been observed in youth courts and other competent administrative bodies in juvenile justice in 11 European countries. The Scottish children's hearing and the juvenile justice practice in Switzerland come forward as examples of best practice regarding the participation of juveniles. A more intimate and informal setting contributes to making the hearing more accessible for the young person and his parents. Furthermore, this study shows that the fulfilment of the requirements for the effective participation of juvenile defendants is not possible in the adversarial youth courts in Europe. Paperback. Condition: New. Millions of children are on the move worldwide. They are fleeing conflicts and wars, they move with or without their parents to attain a better future. This is not a new phenomenon, but its current scale is unprecedented. UN reports suggest that there are currently almost 50 million children who have been uprooted, constituting half of the global refugee population. Migrant and refugee children often find themselves in particularly vulnerable positions, despite the comprehensive human rights protections accorded to them in regional and international legal instruments, including the United Nations Convention on the Rights of the Child adopted 30 years ago. Safeguarding Children's Rights in Immigration Law is a reflection of the growing concern for children and children's rights in immigration in academia and practice. It also analyses the diversity of issues related to immigration and children, such as family reunification, detention, participation, human tracking and the rights of siblings in the context of migration, as well as the significance of regional legal systems and infrastructures for the protection of children on the move. The topics explored in this book emphasise its international scope and importance, making it of interest to academics, practitioners, the wider legal profession and law students everywhere.
