Er ist der Sohn des Dichters und Malers Ai Qing und Halbbruder des Malers Ai Xuan. Nach jüngsten regierungskritischen Äußerungen im Rahmen der Proteste in China 2011 war er seit dem 3. April 2011 an einem unbekannten Ort in Haft. Ihm wird ein Wirtschaftsdelikt vorgeworfen. Der Sprecher des Außenministeriums Hong Wei erklärte: Provokante Menschen wie Ai Weiwei muss man im Zaum halten. Seit Ende Februar 2011 sind etwa 25 Dissidenten verschwunden oder wurden verhaftet, teils mit Familienangehörigen. Am 22. Juni 2011 wurde Ai Weiwei gegen Kaution freigelassen. Ai Weiwei wurde 1957 als Sohn des chinesischen Dichters und Regimekritikers Ai Qing (¿¿, 1910 1996) geboren. Durch die 20-jährige Verbannung des Vaters wuchs er zunächst in der Mandschurei und in Xinjiang auf. 1978 schrieb er sich an der Pekinger Filmakademie ein und studierte dort unter anderem mit den chinesischen Regisseuren Chen Kaige und Zhang Yimou. 1979 war er ein Gründungsmitglied der Künstlergruppe Stars Group, die eine chinesische Kunst nach staatlicher Leitlinie ablehnte. Von 1981 bis 1993 lebte er in den USA, vor allem in New York City, und beschäftigte sich in dieser Zeit vor allem mit Performance und Konzeptkunst. Während seines Aufenthalts in New York schloss er ein Studium an der Parsons School of Design ab. 1993 kehrte er wegen der Erkrankung seines Vaters wieder nach Peking zurück, wo er auch heute noch im Kunstbezirk Dashanzi lebt. 1994 gründete er die Galerie China Art Archives and Warehouse für experimentelle Kunst in Peking. On February 1883 Alexander Hosie - a British consular agent in Chungkiung - begins his adventurous journey from Ch'ung-ch'ing - the greatest commercial center in Western China at the time - for the purpose of exploring the country lying between Ning-yuan Fu, the southernmost prefectural city in the province of Ssu-ch'uan, and Ta-li Fu in western Yünnan, and assessing the commercial potential of this remote part of China. This is a fascinating narrative with vivid description of the country and some remarks on the trade with Western China, pre-dating the author's book, "Three Years in Western China; A Narrative of Three Journeys in Ssu-ch'uan, Kuei-chow, and Yun-nan," first published in 1890. Die Idee eines Gesetzbuches, die Vorstellung einer Kodifikation zur Regelung gesellschaftlicher Konflikte ist keineswegs eine Errungenschaft des Abendlandes. Auch das chinesische Recht kennt seit alters die Form von Gesetzbüchern. Meist wurde es von Dynastie zu Dynastie weitertradiert. Die letzte Dynastie, das Ta-Tsing-Lü-Li, erließ im Jahre 654 n.Ch. eine solches Gesetzbuch, das zwar in weiten Bereichen strafrechtlichen Inhalts war, aber auch privatrechtliche Regelungen aufwies. Über die Frage der Qualität des Gesetzbuches im Alten China herrscht wenig Zweifel, teilweise sind Regelungen aufgenommen, die selbst modernen Ansprüchen genügen würden. Wenn in Konstantinopel im 6. Jahrhundert nicht das Corpus iuris civilis geschaffen wäre, würde Europa dem wenig entgegenhalten können, zumal die frühen chinesischen GesetzbücherJahrhunderte vor unserem Corpus iuris bereits in Kraft waren. In den Jahren 1928 bis 1930 wurde in der Republik ein neues Bürgerliches Gesetzbuch geschaffen, die letzte große Kodifikation des Reiches der Mitte. Vorgabe und Vorlage waren das Deutsche BGB und das Japanische, das teils vom deutschen BGB, aber auch vom Code vivil beeinflusst war. Den beiden Kodifikationen folgend, wollte man ursprünglich das Zivil- und Handelsrecht trennen, was man aber aufgrund der chinesischen Tradition wieder aufgab. Gleichwohl wurde der Name Bürgerliches Gesetzbuch (min-fa) beibehalten. Zur Ergänzung des Handelsrecht wurde in den Jahren 1928 bis 1930 weitere handelsrechtliche Sondergesetze erlassen, etwas das Scheck- oder Wechselrecht betreffend. Die Vorarbeiten zum Bürgerlichen Gesetzbuch der Republik China reichen bis in das Jahr 1911 zurück. Der erste Entwurf erschien 1925, der aber noch erheblich verändert wurde. Das Bürgerliche Gesetzbuch trat abschnittsweise in Kraft, das Erste Buch beispielsweise wurde am 23. Mai 1929 verkündet und trat am 10. Oktober 1929 in Kraft. Zuletzt wurde das Familien- und Erbrecht am 26. Dezember 1930 verkündet und trat am 5. Mai 1931 in Kraft. Über die nachfolgende Zeit der Besetzung durch Japan, des Bürgerkrieges und der kommunistischen Herrschaft bietet juristisch nicht viel Erwähnenswertes. Das moderne China dieser Tag hat eine Gesetzkommission eingesetzt, um ein neues, modernes Bürgerliches Gesetzbuch zu schaffen. Auf der Grundlage des Bürgerlichen Gesetzbuches der Republik China nimmt wiederum das deutsche BGB eine entscheidende Rolle ein.
