In this timely collection, leading anthropologists and cultural critics grapple with that question, examining configurations of humanity in relation to biotechnologies, the natural environment, and humanitarianism and human rights. From the global pharmaceutical industry, to forest conservation, to international criminal tribunals, the domains they analyze highlight the diversity of spaces and scales at which humanity is articulated. The editors argue that ideas about humanity find concrete expression in the governing work that operationalizes those ideas to produce order, prosperity, and security. As a site of governance, humanity appears as both an object of care and a source of anxiety. Assertions that humanity is being threatened, whether by environmental catastrophe or political upheaval, provide a justification for the elaboration of new governing techniques. At the same time, humanity itself is identified as a threat (to nature, to nation, to global peace) which governance must contain. These apparently contradictory understandings of the relation of threat to the category of humanity coexist and remain in tension, helping to maintain the dynamic co-production of governance and humanity. CAPITULO III O PROBLEMA DA INCONSTITUCIONALIDADE DAS LEIS EM FACE A ACTUAL CONSTITUICAO POLITICA DA REPUBLICA 14.--O problema pode colocar-se na Constituicao actual? A distincao entre lei constitucional e lei ordinaria. Deve admitir-se? Qual o significado que deve dar-se a essa distincao? O problema da inconstitucionalidade das leis pode e deve colocar-se agora em face a actual Constituicao politica da Republica visto que ela admite, no artigo 82. e seus, a distincao entre a lei constitucional e a lei ordinaria--diferenca persistente no espirito dos seus principios, pelos quais ja antes, no artigo 63., fora sanccionada. Devera haver, havera hoje, perante uma rigorosa tecnica, distincao de natureza juridica entre a lei constitucional e a lei ordinaria? Nao deve haver--nem ha. Nao quero cuidar por ora se e ou nao falso o criterio de fim, que se toma para base quando se procura afirmar uma diferente natureza juridica 66 entre aquelas leis; e sustento que no proprio seio da doutrina que assim expoe nao ha elementos que conduzam a uma distinccao daquela ordem. Tem um conteudo proprio a lei constitucional--dizem. Qual? Nao e unanime a forma por que em face aos estados modernos definem Constituicao ou lei constitucional aqueles mesmos que a reputam com diversa natureza da lei ordinaria, e isso sera ja uma condicao desfavoravel. De facto, uma nocao apresenta Wilson, quando Palma, Esmein, Brunialti, Boutmy e Orlando apresentam outras diversas, e, entre nos mesmo, nao e igual a maneira por que os Professores da Universidade de Coimbra a definem. Mas os seus diferentes pontos de vista nao mutilam talvez uma nocao que pode apresentar-se como reunindo muitos pareceres, quando se diga que a Constituicao e uma regra objectiva que organisa a soberania sobre a base de uma separacao de poderes, com fim a obter o reconhecimento e garantia das.
