Tre opere in un volume di cm. 18,5. Primo frontespizio in rosso e nero; testo in latino intercalato da alcuni passi in gotico. Legatura coeva in piena perg. rigida con titoli ms. al dorso. Tracce di tarlo limitate alla legatura; bruniture e fioriture tipiche della carta tedesca del tempo, peraltro esemplare nel complesso genuino e in buono stato di conservazione. Ahasver Fritsch (1629-1701), giureconsulto tedesco nativo di Mucheln, insegnò all'Università di Jena in Turingia e scrisse alcune fortunate opere, principalmente di taglio giuspubblicistico e romanistico. Queste tre opere, tutte in edizione originale, sono molto interessanti. La prima descrive la disciplina del transito delle truppe militari: modalità di passaggio e cause di negazione del transito secondo le consuetudini, il diritto romano e il diritto imperiale. La seconda è dedicata agli archivi pubblici e al ruolo degli archivisti; secondariamente alle cancellerie, uffici fondamentali nella conservazione degli atti processuali. La terza opera, anch'essa interessantissima, è dedicata alle armi da getto (missiles): denominazione, origine e propagazione dell'uso, disciplina nel diritto romano (novella De Consulibus). Header titles cropped close on 5 leaves. All printed marginal notes present and completely untouched. Bound in period speckled paper covered boards with orange leather and gilt title label. Overall in so so condition with edge wear and some lost to outer paper layer but text block holding very firm. A rare thesis on Roman Property Laws by a Lutheran, reprinted in the late 1700's. Ex Libris Bibiotheca Summi Tribunalis no, 3881 with their bookplate on the front paste down. Also Ex Libris Koen Preuss Landgericki with his small purple ink rubber armorial stamp on the title page. It's a shame more use wasn't made of this book. For although it appeared a bit too late to help the German Peasants in their revolt against the powers that be and had heaped upon their heads (those that were still attached to their bodies) the opprobrium of Martin Luther. It might have helped the Jews of Third Reich retain at least some of their property--fat chance. It calls to mind the truth of the truism "first let's hang all the lawyers---then the used car salesmen, telemarketers, antiquarian book dealers and anybody else we can get our hands on. Robert Joseph POTHIER (1699-1772), geboren in Orléans als Sohn eines Richters, begann im Jahre 1715 sein Rechtsstudium in seiner Heimatstadt. Nach dem Abschluß seines Studium erhielt er 1720 eine Richterstelle an dem Präsidialgericht, an dem schon sein Vater tätig war. Im Jahre 1750 erhielt Pothier in Orléans einen Lehrstuhl für französisches Recht, den er trotz verlockende Angebote, nach Paris zu wechseln, bis zu seinem Lebensende beihielt. Pothier begann sein wissenschaftliches Oeuvre mit einer kritischen Ausgabe der Coutumes von Orléans. Im Jahre 1748 edierte er erstmals seine berühmten Pandectae Justinianeae in novum ordinem redactae, der ihm rasch europäischen REuhm einbrachte.
