Traccia di tarlo limitata ad una ventina di cc. con lesione di alcune parole, strappetto all'angolo alto di c. 121 (senza interessamento di testo), alcune macchiette sparse, sporadici e marginali aloni, peraltro esemplare nel complesso genuino e ben conservato. Jean Faber (12?-1340), detto Joannes Roncinus, fu giureconsulto francese di considerevole fama ed autorità. Dedicatosi ben presto all'opera d'attualizzazione del diritto romano, produsse questo celebre commentario alle Istituzioni giustinianee oltre ad un Breviarium del Codex tralatiziamente attribuitogli. Tiraqueau, du Moulin e Boerius lo definirono rispettivamente "vir apud nos maxime autoritatis", "subtilissimus et consumatissimus juris doctor" e "summum Franciae Consuetudinarium" (cfr. Taisand, Les vies des plus celebres jurisconsultes, ed. 1737, pp. 181-82). In definitiva Faber va inserito a pieno titolo fra gli eredi della grande tradizione degli Ultramontani. Oltre che creatore di dottrina fu, così riportano le antiche biografie, impegnato come giudice e, notizia su cui peraltro sussistono dubbi, come cancelliere di Francia. L'opera appare fondata sulle dottrine di Azzone, Dino del Mugello, Guido da Baisio, Innocenzo IV, Enrico da Susa (ed ovviamente Jacobus de Ravanis) e va cronologicamente inserita nel contesto storico-dottrinale immediatamente pre-bartoliano. Seltenes Institutionenlehrbuch des hochgelehrten französischen, humanistisch ausgerichteten Juristen und Wegbegleiters Calvins! Francois HOTMAN (1524 - 1590) begann seine Studien in Paris und trat bereits im Jahre 1547 zum Calvinismus über. Gegen den Willen seiner Eltern reiste er nach Genf zu Calvin, der ihm eine Professur für lateinische Sprache verschaffte. Im Jahre 1555 ging Hotman nach Straßburg, eine Empfehlung des Baseler Juristen und Verlegers Basilius Amerbach begleitete ihn. Rufe an die neu gegründeten protestantischen Universitäten von Königsberg und Marburg schlug er aus. Zunächst promovierte er am 18. September 1558 in Basel. Die nächste Zeit war im Leben Hotmans voll dem Glaubenseifer gewidmet. Er verfaßte Pamphlete, stellte sich in den Dienst protestantischer Fürsten, so auch bei Landgraf Wilhelm von Hessen, der ihn für die Universität Marburg zu gewinnen suchte. Doch Hotman kehrte nach Frankreich zurück: 1563-1567 Professor in Valence. Im Jahre 1567 wurde er an der berühmten Universität Bourges der Lehrstuhlnachfolger von Cujas. In der Bartholomäusnacht (1572) entkam er knapp der Ermordung und flüchtete wieder nach Genf. In den Jahren 1573 bis 1578, wie ehemals in den Jahren 1548 bis 1549, lehrte er an der Akademie zu Genf. In den Jahren 1578 bis 1584 (wieder 1589 - 1590) lebte er als freier Gelehrter in Basel, schlug Berufungen nach Leiden und auch nach Heidelberg trotz glänzender Konditionen aus: er fand die dortigen Lehrbetriebe zu lasch und lau. Er selbst verbitterte immer mehr, litt bisweilen am Mangel des täglichen Brotes, brüskierte engste Freunde mit "rücksichtsloser Meinungsoffenheit", wurde sektiererisch und glaubensmäßig unerbittlich. In seinen Werken spürt man stets den überragenden Philologen, auch im Vergleich zu seinen zeitgenössischen Juristen. Francois HOTMAN setzte die große Tradition der Rechtsschule von Bourges fort: Budaeus, Alciatus, Donellus, Duarenus und dann Hotomanus. Hotman war wie seine berühmten Vorgänger Philologe und Altertumsforscher, beide Bereiche sind Grundvoraussetzung für seine wichtigen textkritischen Arbeiten. Noch zu seiner Baseler Zeit verfasste HOTMAN seinen Institutionenkommentar, der sowohl in Basel (1560) wie in Lyon (1565) (vgl. Coing, Handbuch II,1172, Holthöfer) verlegt worden ist. Im Jahre 1567 trat er seine Professur in BOURGES an, der damals berühmtesten Europäischen Universität. Die zweite, von Hotman durchgesehene Auflage erschien im gleichen Jahr. Sieben Jahre seien seit der ersten Ausgabe vergangen, resümiert Hotman in seinem Vortwort: "septimus iam annus abiit, ex quo nostros hosce eoasdem in Institutiones Iuris commentarios.evulgavimus." Das Vowort ist datiert mit dem April 1567. Es folgt ein Vorwort von Hotman: Argumentum huius Operis, in dem er Grund, Struktur und Vorgehensweise des Institutionenkommentars darlegt. Es folgt eine Lebensbeschreibung von Kaiser Justinian: Iustiniani Imperatoris vita: Iustinianus humili & obscuro genere ortus est. Es folgt der umfangreiche Kommentar von Hotman, der den humanistisch orientierten und philoloigisch geschulten Rechtsgelehrten leicht erkennen läßt. Hotman zitiert zunächst den Gesetzestext und läßt bei entsprechenden Worten ausführlicher Erläuterungen folgen. Der Kommentar von Hotman ist mit Sicherheit der gelehrteste von allen Kommentaren und keinweswegs als Einleitungslehrbuch zu den Institutionen zu verstehen, sondern als eine gelehrte Aufbereitung der Justinianischen Institutionen.
