Gholson, J. On the 19th of November, 1858, the defend, ant filed a petition in the court of common pleas of Hamilton county, claiming to be the owner of the ground, on both sides of certain parts of two streets, in the city of Cincinnati, de scribed in the petition, stating that it would conduce to the general interest of the city, to have the parts of the two streets vacated, for the purpose of erecting public buildings for the use Of the county. Notice of the filing of the petition was given, by posting a copy on the door Of the court-house, and by publication in a newspaper zof general circulation in the county. The notice contained the substance and prayer of the petition. The court Of common pleas, by an order made on the l0th of February, 1854, approved of the notice, and of the proof of publication.
