Under federal and state statutory law, marijuana is commonly defined as all parts of the plant Cannabis sativa L., whether growing or not. This includes the seeds, resin and any derivatives, mixtures, or preparations of the plant. The federal definition, as well as those of most states, exclude the mature stalks of the plant as well as the sterilized seeds.
As the courts quickly, marijuana users were often more sophisticated than the legislators who wrote the legal definition of marijuana. In several court cases, users charged with possession of marijuana argued that they possessed the species Cannabis Indica, not Cannabis Sativa, and that the law, by its own terms, only outlawed Cannabis Sativa.
