The Puerto Rico Bar Association (Colegio de Abogados y Abogadas de Puerto Rico, hereinafter Colegio) ever vigilant of the access to justice by the social components who suffer the most the ravages of the financial and economic crisis, that seems to be a constant in Puerto Rico for the past nine years, instituted a Bankruptcy Commission. The purpose of the Bankruptcy Commission is to promote the study and knowledge of Bankruptcy Law among attorneys and the components of the Puerto Rico Judicial System. The Commission also provides necessary information on the different financial alternatives available in the Bankruptcy Code to all citizens who seek information from the Colegio on how to solve and reorganize their financial problems; be it an insolvent debtor or creditors who seek to protect their commercial interests. The Bankruptcy Commission is composed of a number of attorneys concentrating in Bankruptcy Law. In the Commission there is representation of the different sectors that participate in the bankruptcy process: attorneys who represent debtors and creditors; Chapter 7 and 13 Trustees Our objective is to deliver, through continuing legal education courses of a dynamic and engaging format, high quality education on substantive, procedural, evidentiary, advocacy and, trial skills to the bankruptcy practitioner. We also pursue the objective of providing the Commonwealth of Puerto Rico Court of First Instance practitioner with courses on bankruptcy and its impact in the cases and matters they handle. Members of the Bankruptcy Commission collaborate with other educational institutions and law related entities, like the Law Schools, the Puertorrican Judicial Academy, Puerto Rico Legal Services Corporation and the Puerto Rico Department of Justice in providing legal education on Bankruptcy. An exemplary product of this educational effort, displayed by all the members of the Bankruptcy Commission with the valuable support of the Colegio de Abogados y Abogadas de Puerto Rico, represented by its President, Mark A. Bimbella, Esq., through its Legal Journal, “La Revista”, and its Editor, Carlos Gil, Esq., is that which we proudly present to you: a collection of articles related to bankruptcy in this extraordinary edition of the Revista del Colegio de Abogados y Abogadas de Puerto Rico. The articles or essays presented to you here have the purpose of discussing substantive and procedural aspects of Bankruptcy Law from the perspective of the attorneys who litigate on a daily basis before the Honorable Bankruptcy Court for the District of Puerto Rico. Some of the articles are written by attorneys with many years of experience, while others are written by attorneys of lesser years of experience yet all have a profound understanding of Bankruptcy Law. Many of the authors have devoted all of their professional experience to practice before the USBC, from the moment of their admission to the federal forum.
