Als ich mich vor etwa sechs Jahren veranlasst sah, dem Ver tragsproblem, und insbesondere dem Problem der „stillschweigenden Willenserklärung näher zu treten, war ich mir im Vorhinein darüber im Klaren, dass es keineswegs eine genaue Begriffsbestimm ung der letzteren ist, woran es der Wissenschaft fehlt. War doch die begriff liche Analyse stets der Ausgangspunkt aller Untersuchungen über die „stillschweigende Willenserklärung. Es schien mir viel mehr der Mühe werth zu sein, einmal den umgekehrten Weg ein zuschlagen, nicht den Begriff selbst, sondern die konkreten Fälle zu untersuchen, in denen mit dem Begriffe der „stillschweigenden Willenserklärung operirt wurde, die Beantwortung der Frage zu versuchen: welche Rolle spielt die „stillschweigende Willenserklä rung im Rechtsleben?
