Some soiling, some foxing, still a good copy. $100. *First edition. In a final attempt at imposing a Federalist philosophy upon the judiciary Congress passed the Judiciary Act of 1801. Under its terms the Supreme Court was reduced from six to five members, circuit court duties were denied, and six new circuit courts and sixteen new judgeships were created. "The repeal debate thoroughly canvassed the issue of judicial review, set forth the Jeffersonian theory of legislative supremacy and furnished the political setting for Marbury v. Madison."
