Hardcover. Condition: Near Fine. Hardcover, xv + 210pp, NOT ex-library. A clean and bright copy with unmarked text, free of inscriptions and stamps. Firm secure binding. Published without a dust jacket. --- The book examines how the absence of insurance in the past led to some special maritime liability law principles such as 'general average' (i.e., losses or expenses shared by all the parties to a maritime adventure) and the limitation of shipowners¿ liability. In the absence of insurance, these principles served the function of insurance mostly for shipowners. As commercial marine insurance is now widely available, these principles have lost their justification and may in fact interfere with the most important goal of liability law i.e., deterrence from negligence. The work thus recommends their abolition. It further argues that when insurance is easily available and affordable to the both parties to a liability claim, the main goal of liability law should be deterrence as opposed to compensation. This is exactly the case with the maritime cargo liability claims where both cargo owners and shipowners are invariably insured. As a result, the sole focus of cargo liability law should be and to a great extent, is deterrence. On the other hand, in the vessel-source oil pollution liability setting, pollution victims are not usually insured. Therefore, oil pollution liability law has to cater both for compensation and deterrence, the two traditional goals of liability law. The final question the work addresses is whether the deterrent effect of liability law is affected by the availability of liability insurance. Contrary to the popular belief the work attempts to prove that the presence of liability insurance is not necessarily a hindrance but can be a complementary force towards the realization of deterrent goal of liability law. --- Contents: 1. Introduction 2. Lack of Insurance and Its Effect on Maritime Liability Law: A Historical Evaluation 3. Insurance and Limitation of Ship owners? Liability: An Economic Analysis 4. Insurance through General Average: Its Justifications and Effects on Optimal Care and on Social Costs 5. Maritime Cargo Liability Regimes in Light of Insurance Realities 6. Role of Insurance in Providing Adequate Compensation for Oil Pollution Damage and in Reducing Oil Pollution Incidents 7. Incentive Effect of Liability Rules in the Presence of Liability Insurance 8. Conclusion.

Taschenbuch. Condition: Neu. This item is printed on demand - it takes 3-4 days longer - Neuware -Climate change is increasing the frequency and intensity of natural disasters which are adversely impacting developing countries like Bangladesh - increasing economic, socio-cultural, informational, psychological and physiological vulnerabilities. Disaster management is one effective option to reduce the vulnerability to ensure their continued wellbeing. This research attempts to understand how the power of ICTs can benefit disaster management and then to investigate what should be the key components in designing a sustainable disaster management system. The research finds that although ICTs are a key tool for natural disaster management, they need to be implemented through a proper management system, involving local communities in order to be effective. The research identified three components of sustainable natural disaster management systems - ICTs, community and management. The findings of this research suggest that proper attention must be paid to the assessment of information and communication needs. Political support at all levels is also a critical success factor for the operation of a sustainable disaster management system in countries like Bangladesh. 112 pp. Englisch.

Closely related to the realm of finance and socioeconomic discussion, the phrase sustainable impact finance has become increasingly popular among bankers, practitioners, financial analysts, investors and the relevant experts seeking an impactful connection between the best financing mechanisms or tools and sustainable development related investments or projects. This book opens up the discussion by offering a Shariah-compliance perspective. It is a primer on how Islam addresses and offers solutions to the challenges facing us within the spirit of maqasid al-Shariah, among others, in tackling poverty, food supply, health and well-being, quality education, reducing inequalities, responsible consumption and production and climate action. It discusses the connection between Islamic sustainable finance and the Sustainable Development Goals (SDGs) and explains the strategic action-plan of Islamic banks towards achieving Islamic sustainable finance. The book considers the relevant policies and regulations, evaluating the role of regulators, discussing jurisprudential solutions and focusing on the role of Islamic banking standards in relation to Islamic sustainable finance. Further, it explores the issue of risk mitigation and the effective role of Takaful.
