Due to the fact that there is no possibility for a community to own land or to hold fee simple estates in land, English Law has developed limited access 'communal property rights'. These rights can be exercised over areas known as commons.Commons have their origin in the agricultural tradition that has been established in the late 11th century to use the harvested fields together for common grazing of the animals of all members of a locality. Out of these local customs evolved the so called 'rights of common' as part of the communal property rights. They are held by distinct individuals of a community and include rights such as fishing, grazing or to collect firewood which can be asserted by them.Over time, the use of particular rights of common decreased due to the industrialization. The changing reliance of the people on certain resources such as timber and the second communal property rights called customary rights of fluctuating bodies gained in importance. They can only be acquired by custom or by long use and have the peculiarity that they can be exercised, once they have been established, by anybody independently of ownership as long as he belongs to the particular local community.One of the most frequently exercised customary rights is the right of recreational use on which this paper puts the focus on. This use has been very limited in the history of English law, but in the 13th century some land has been increasingly used by the local inhabitants for recreation or sports and the courts started to declare a land as town or village green with protection from interference if a long term use could be verified.Since the 19th century the centre of gravity shifted from the agricultural benefits of town or village greens to the recognition of the large general public interest in recreation and the countryside. Criminal statistics are frequently used by politicians or in the mass media to substantiate an allegation without challenging the data. With the emergence of globalization starting in the last century it became evident that there is a need to approximate the existing rules to foster international trade. In theory, this should allow all participating actors to benefit more than ever leading in the long run to greater wealth for everyone. In 1980, 42 countries agreed on the CISG to address hindrances to the growing international trade by adopting a default uniform international framework for the sales of goods. The preamble specifies that 'the adoption of uniform rules which govern contracts for the international sale of goods and take into account the different social, economic and legal systems would contribute to the removal of legal barriers in international trade and promote the development of international trade'. At the time of writing, the CISG has been in force for 27 years and it is time to evaluate whether the goals the drafters had in mind have been achieved. In order to assess the successfulness of the CISG to promote a unified international sales law a multitude of factors can be taken into account. To not unduly exceed the limits of this paper the author determined three key criteria on whose basis the successfulness will be evaluated. Firstly, the acceptance of the CISG in the international community will be evaluated. Secondly, the influence of the CISG on subsequent international, regional and domestic legislation and initiatives relating to sales and contract law will be addressed. Besides the more famous accomplishments such as the subsidization of renewable energy sources or emission trading a new technology emerged in the past decade, Carbon Capture and Storage (CCS).It can be described, in general, as a technique to reduce CO2 emissions into the atmosphere by sequestrating it from fossil fuels and storing it into geological formations in the ground or in the sub-seabed. In chapter 'B' this paper will give an overview about the technological concept of CCS and the various approaches that are currently examined by scientists.CCS is seen as one of the most feasible climate change mitigation options due to its capability to reduce the emission of CO2 into the atmosphere without abandoning the use of fossil fuels. To do justice to this rating, it is necessary to support the deployment of CCS by developing and constructing legal frameworks and regulations that are flexible enough to allow for new technological advancements. Bei dieser weitreichenden und schwerwiegenden Entscheidung muss der Rechtsstaat eine Balance finden zwischen den Grundrechten eines Straftäters, wie etwa der Unverletzlichkeit der Würde eines Menschen und das Recht auf die freie Entfaltung seiner Persönlichkeit aus Art. 1 in Verbindung mit Art. 2 GG, und dem allgemeinen Anspruch der Bevölkerung durch den Staat vor jeglichen Gefahren, vor allem aus der Gesellschaft selbst heraus, beschützt zu werden. Als Paradebeispiel für diesen Grundrechtskonflikt kann das Institut der Sicherungsverwahrung im deutschen Strafrecht herangezogen werden. Gemäß 66 ff. StGB haben deutsche Strafrichter die Möglichkeit für schuldfähige Täter, neben der Verurteilung zu einer Haftstrafe, eine Sicherungsverwahrung anzuordnen, wenn der Täter zu schwerwiegenden Straftaten neigt und somit eine Gefahr für die Allgemeinheit darstellt. Problematisch ist hierbei vor allem, dass ein Gericht darüber entscheiden muss, ob jemand möglicherweise in der Zukunft erneut eine schwerwiegende Straftat begehen wird und diese Möglichkeit als so realistisch eingeschätzt werden kann, dass ein präventiver Freiheitsentzug eine angemessene und legitime Maßnahme ist.Nicht überraschend beschäftigte ein solch brisantes Thema verschiedene Instanzen, allen voran das Bundesverfassungsgericht2. Dieses hatte die Sicherungsverwahrung grundsätzlich in der vom deutschen Gesetzgeber vorgesehenen Form als zulässig und verfassungskonform anerkannt. Interessanter ist vielmehr, dass der EGMR in zwei Entscheidungen eben dieses System der Sicherungsverwahrung, beziehungsweise Teile dessen, als einen Verstoß gegen die EMRK gewertet und zu Gunsten der jeweiligen Kläger entschieden hat.Das neue Urteil des Bundesverfassungsgerichts3 wurde folglich aus zweierlei Gründen mit Spannung erwartet. Zum einen ist es fraglich wie das Bundesverfassungsgericht mit den Entscheidungen des EGMR umgehen wird, vor allem vor dem Hintergrund vergangener Urteile, und ob es einen Weg finden kann, das Verhältnis der beiden Gerichte zueinander nicht zu belasten. Zum anderen erhoffen sich der deutsche Gesetzgeber und die deutsche Judikative endlich Rechtssicherheit darüber, welche Normen zulässig und anwendbar sind. Diese Thematik betrifft aber hauptsächlich Länder der Dritten Welt und trifft bei den beiden Staaten, auf die bei dieser Arbeit der Fokus gelegt wurde, die Bundesrepublik Deutschland und die Niederlande, nicht zu.Gegenstand der Arbeit soll vielmehr der Vergleich darüber sein, welche Methodik in den beiden Staaten entwickelt wurde und heute angewendet wird, um den demokratischen Grundsätzen, der möglichst akkuraten Repräsentation des Volkes als Souverän und der Regierbarkeit eines Landes gerecht zu werden.Hierfür werde ich im ersten Teil den Leser an die allgemeinen Begrifflichkeiten der Wahl und der Wahlsysteme heranführen, um den Grundstein für den zweiten Teil zu legen, in dem es detailliert um die beiden Wahlsysteme der Bundesrepublik Deutschland und der Niederlande geht. Biofuels can be defined as solid, liquid or gas fuel consisting of, or derived from biomass, which is composed of living and recently dead biological material. The best-known products are bioethanol and biodiesel, which are first generation biofuels derived from renewable resources, in particular food crops.
