Collection includes c. 70 individual items; mostly involved with clearing the estates of James Wright and that of Nathaniel Pearsall; with many of the documents involving both of these families and heirs from each; interesting accounts of estate contents, will bequests, debts being paid; Pearsall appears to have been a wagon maker and this is reflected in various documents; James Wright seems to have been an attorney or legal advisor and is also an executor for some of the materials; there are documents relating to the estate of Israel Wright and other relations as well; various paper sizes and qualities; some wear and soiling, old fold lines; a few of the documents with old tax-stamps still affixed; about 1/2 dozen of the James Wright receipts' writing going pale, still legible; overall, in good to very good condition and a good micro-glimpse of these family's fortunes and legal arrangements on Long Island in the middle part of the 19th century.

Content in neat hand, franked in different hand on verso. $500. * This document is signed by two early settlers, Ebenezer Belding and Reuben Belding. It reads, in part: "To Lieut. Obdiah Dickeson proprietors Treasure of Huntstown so called we the subscribers Being of the Committee of accounts of the s[ai]d proprietors Desire you wood [sic] pay to Nathan Chapin of Huntstown so called the sum of two pound thirteen shillings Lawfull money Being his Bill for procuring Law Books for s[ai]d proprietors and passed by us." Early Manuscript Notes on Elizabethan Poor Laws [Manuscript]. [Poor Laws]. Expositions upon the Statute of 43 Eliz. for the Poare. N.p., c.1633. [13] pp. manuscript text on 8" x 6" sheets interleaved and bound into [27] ff. 11" x 7-1/2" blank book. Later three-quarter vellum over marbled boards, gilt title ("Statute of 43. Eliz. (For the Poor)") to spine, top-edge gilt, fore and bottom edges untrimmed, ownership signature of Walter Ashburner, Lincoln's Inn dated 1902 to front pastedown, small bookplate ("Bibliotheca Confanoneria") to front free endpaper. Light rubbing to boards, moderate rubbing to board edges, light soiling to vellum, faint offsetting, light soiling and small penciled marks to endpapers. Light toning to interior, light foxing and negligible light soiling, light edgewear to manuscript leaves, just affecting text of a few leaves but without loss to legibility. Text in neat secretarial hand. $2,600. * The reign of Elizabeth I saw numerous attempts to relieve poverty through legislation. From 1552 to 1598, a series of statutes were passed which empowered justices of the peace and churchwardens to register the poor and raise funds for their relief. The so-called "Elizabethan Poor Law" of 1601 consolidated the previous legislation and provided for the creation of "overseers" of relief, who would work under justices of the peace to set a compulsory sum to be extracted from each parish, among other duties. The effects of the 1601 law and other "poor laws" resonated widely, from the penal system to the labor market to universities and the education system in general. The text of our manuscript relates to the so-called "Resolutions of the Judges of Assize" of 1633. These "resolutions," intended to address ambiguities in the 1601 Poor Law, take the form of a series of questions submitted to Chief Justice Heath and his answers. "Although apparently repudiated after the Restoration as invalid, Heath's interpretations were nonetheless employed consistently by both magistrates and judges as the standard guide to the rigorous enforcement of the poor laws which characterized the 1630s" (Cockburn). The text subsequently appeared in print in various justice of the peace manuals, with the earliest of these appearances around 1655 in Dalton's Countrey Justice. Our manuscript likely pre-dates printed versions of the tex.

A la suite d'un contrat passé quelques années auparavant, François Dubernet, bourgeois et marchand de Bordeaux, s'était porté caution d'un certain Louis Roux, également de Bordeaux. Ce dernier, décédé, laissait des dettes que Dubernet refusa de payer, estimant qu'elles incombaient aux héritiers du sieur Roux. L'affaire fut portée devant le parlement de Bordeaux qui donna tort à Dubernet et ordonna la saisie d'une maison lui appartenant: "Icelle maison avec sa propriette appartenances et deppendances appartenant audict Dubernet qui estoit scize et scituee pres le portal du pont Sainct Jehan paroisse de Sainct Michel de nostre ville de Bourdeaulx, confrontant d'ung couste de la maison des heritiers dudict feu Roux et de François Foucquet bourgeois et marchant de Bourdeaulx qu'il avoit acquise du dict Roux, d'aultre couste à la maison de Sauveur Bonhomme aussy bourgeois et marchant de ladicte ville." (f. 2). Une affiche annonçant la saisie est alors apposée sur la porte de la maison, ainsi que sur la grande porte de l'église Saint-Michel. Puis une deuxième maison est saisie: il s'agit de la "maison noble du Luc", située dans la paroisse d'Eyzines (Eysines, à 7 km au nord-ouest de Bordeaux). Des affiches sont également apposées (f. 8), mais Gratien de Mulet, sieur de La Plane, fait opposition, ayant acquis de Dubernet en 1573 des droits sur la dîme d'Eyzines: "Aussy oppose audict proces et susdictes criees Gratien de Mullet escuyer sieur de la Planne et par ses causes d'opposition auroit dict que dès le dix neufiesme du moys de decembre mil cinq cens soixante treize il avoit acquis d'icelluy Dubernet deffandeur la tierce partie les trois faisant en tout de la grand dixme [de] la paroisse d'Eyzines" (f. 12 v°). Suit une nouvelle opposition, par un créancier cette fois (f. 23), puis une requête concernant Jeanne Augier, épouse de Dubernet, "aux fins qu'elle eust à desduire les droits qu'elle avoit sur les biens saisis" (f. 29). Celle-ci fait également opposition, en son nom et au nom de ses enfants. La procédure se complique par le fait qu'une partie des biens de François Dubernet provenait de l'héritage de son frère Michel, et qu'il pouvait prétendre à en conserver une partie selon la règle de la "quarte trébellianique" (f. 34 v°). Ainsi, une partie de ses biens ne peut être saisie. Puis Jeanne Augier fait une seconde opposition en mentionnant l'héritage d'un autre frère décédé, Jean Dubernet, qui pourrait aussi faire l'objet d'une quarte trébellianique: "Par disposition du droict il falloit que les biens vendus par ledict Francois Dubernet feussent imputés en sa legitime et quarte trebellianique et par consequant en la moitie des biens a luy obviants par le deces du susdict frere." (f. 46 v°). Elle demande ensuite la dîme vendue au sieur de La Plane, ainsi que la troisième partie de la dîme vendue sur les biens saisis, autres que ceux distraits en sa faveur (f. 48). A son tour, Dubernet fait une offre concernant la tierce partie des biens saisis (f. 52); il est ensuite question de la mise en fermage de la maison du Luc (f. 61 v°), puis des 28 contrats d'acquisition qu'il a produits (f. 80). Suit une requête de Jeanne Augier pour demander que la tierce partie des deniers de l'enchère des biens saisis soit réservée à ses enfants : "Elle requiert que la troiziesme partie des deniers des encheres qui seront distraicts au proffit de ses enfans demeurent entre les mains de l'adjudicataire desdits biens en luy payant l'interest de ladicte somme." (f. 81 v°). Puis François Dubernet se fait représenter par un autre Jean Dubernet, conseiller à la cour, afin de racheter une partie de ses biens, mais Gratien de Mulet, sieur de La Plane, surenchérit et remporte l'adjudication. Une décision est finalement prise par le parlement de Bordeaux: "Nostre dicte cour ayant veu les pieces desdits de La Plane Francois Dubernet et Jehanne Augier [.] auroit par aultre son arrest du vingt neufiesme jour du dict mois de may au mesme an mil cinq cent quatre vingts treize interinant la susdicte requete dudict de Mullet quant a ce ordonne ouy lesdites parties en la chambre [que] ledict de Mullet consigneroit reallemens et de faict la somme de treize mil troyes cens trente troyes livres treize sols quatre deniers tournois mentionnes en ladicte requeste au greffe de ladicte cour [.] pour estre icelle somme baillee et deliveree aux creantiers du dict Francois Dubernet selon les rengs mentionnes en l'arrest d'adjudication de ses biens et le restant de la somme de vingt mil livres revenant à six mil six cens soixante six livres six sols huict deniers demeureroit du consentement des parties entre les mains dudict de Mulet jusques a ce qu'il seroit employe a l'achapt des biens immeubles au proffit des enfans dudict Dubernet." (f. 107 v° à 108 v°). Gratien de Mulet dépose donc une somme de 13333 livres 13 sols et 4 deniers auprès de Me Urbain Boucault, notaire en la chancellerie de Bordeaux, pour terminer la procédure. Les Archives départementales de la Gironde conservent un document relatif à la vente, en 1573, par François Dubernet, seigneur de la maison noble du Luc, de la tierce partie de la dîme d'Eyzines en faveur de Gratien de Mulet, seigneur de La Plane (cote Eyzines - G 100, 1573-1704). Gentilhomme ordinaire de la chambre du roi, Gratien de Mulet était aussi propriétaire d'un hôtel particulier rue du Hâ, à Bordeaux. Conseiller au parlement de Bordeaux depuis 1585, Jean II Dubernet était le père de Joseph Dubernet (1580-1652), premier président au parlement de Bordeaux, et l'aïeul du célèbre philosophe et écrivain Montesquieu (1689-1755).
