Vinson was Chief Justice of the United States saw the fundamental freedoms of speech, belief, and association put in extreme jeopardy by the stresses of the Cold War. During these years civil liberties cases formed by far the most important issue to come before the Supreme Court; and controversy over civil liberties cases marked the rising tide of disagreement among the members of the Court - which in its most recent term was unanimous in only 19 per cent of its decisions. Civil Liberties and the Vinson Court is a reasoned and timely study of the position of the Vinson Court on the basic issues of civil liberties and the position of the individual justices as seen in their dissenting opinions. Special attention is given to the rights of Negroes and aliens as affected by the decisions of the Court; and the breakdown of the ancient Anglo-Saxon prohibition against executive imprisonment is examined in some detail. The Supreme Court s interpretation of the First Amendment under Chief Justice Vinson also shows an interesting division between the liberal justices, who believed in active support of libertarian claims by the justices themselves, and those who, while basically liberal, were often unable to take liberal action because of principled deference to the legislative branch. Out of this record of the Vinson Court, its members, and its reaction to the antilibertarian pressures of the times, Mr. Pritchett has forged a real history of the civil liberties struggle and its protagonists. His synthesis of the opposed liberal positions of Justices Black and Douglas, on the one hand, and Frankfurter, on the other, suggests a genuine unified liberal approach to the problem of judicial review.
