Soft cover. Condition: Fine. Original publisher's beige wrapper with staple binding. August 10, 1950. 5 7/8" x 9 1/8." Eleven pages, complete. Very slight wrinkling at the edges. Staples are rusted internally. Pages are very clean and intact. A fine copy. Court proceedings against Philip Bart, who was interrogated after being subpoenaed by the Committee on Un-American Activities (HUAC). HUAC was a committee under the House of Representatives formed in 1938 to investigate citizens and organizations thought to have Communist or Fascist ties. These proceedings took place in 1950 at the height of the Red Scare during the Cold War when McCarthyist tactics were common. Philip Bart was a general manager of the Daily Worker, a Communist newspaper, and Freedom of the Press Company, which published the newspaper. Bart was asked a series of questions regarding his role as an organizer of the Communist Party in Ohio, his last name, his citizenship status, passport, persons of interest, and the like, but he refused to answer many of them citing the Fifth Amendment of the Constitution. Bart was indicted on thirty-two counts of contempt for not answering that number of questions but was convicted on eight counts after twenty-four were dismissed. In Bart v. United States (1955), the judgment of Bart was reversed with directions to the District Court to enter a judgment of acquittal based upon the findings that Bart was not properly informed as to whether he definitively had to answer the questions or not and thus could not be held in contempt of the court. The cases of Quinn v. United States and Emspak v. United States were used as precedents for this case.

Soft cover. Condition: Fine. Original publisher's beige wrapper with staple binding. August 10, 1950. 5 7/8" x 9 1/8." Ten pages, complete. Very slight wrinkling at the edges. Staples are rusted internally. Pages are very clean and intact. A fine copy. Court proceedings against Julius Emspak, who was interrogated after being subpoenaed by the Committee on Un-American Activities (HUAC). HUAC was a committee under the House of Representatives formed in 1938 to investigate citizens and organizations thought to have Communist or Fascist ties. These proceedings took place in 1950 at the height of the Red Scare during the Cold War when McCarthyist tactics were common. Julius Emspak was the General Secretary-Treasurer of a labor union called the United Electrical, Radio & Machine Workers of America and the Editor of UE News, the union's official newspaper. Emspak was asked a series of questions concerning any Communist activities. Emspak refused to answer many of the questions based upon "the first amendment, supplemented by the fifth." Due to his refusal to answer the questions, Emspak was convicted on multiple accounts of contempt. In Emspak v. United States (1955), the judgment of Emspak was reversed with directions to the District Court to enter a judgment of acquittal based upon the findings that Emspak was not properly informed as to whether he definitively had to answer the questions or not and thus could not be held in contempt of the court. The case of Quinn v. United States was used as a precedent for this case.

No Binding. Condition: Fine. 1st Edition. Original publisher's beige wrapper. August 10, 1950. 5 7/8" x 9 1/8." Five pages, complete. Pages are very clean and intact. The pages are slightly bent with minuscule wrinkles. A Fine copy. Court proceedings against James J. Matles (1909-1975), who was interrogated after being subpoenaed by the Committee on Un-American Activities (HUAC). HUAC was a committee under the House of Representatives formed in 1938 to investigate citizens and organizations thought to have Communist or Fascist ties. These proceedings took place in 1950 at the height of the Red Scare during the Cold War when McCarthyist tactics were common. Matles was a General Secretary-Treasurer of a labor union called the United Electrical, Radio & Machine Workers of America (UE) and founder of the Committee for Industrial Organization (CIO) which UE operated under. During the proceedings, Matles was asked a series of questions concerning any Communist activities. Matles refused to answer many of the questions based upon the First and Fifth Amendments of the Constitution. Due to his refusal to answer the questions, Matles was placed "in contempt of the House of Representatives of the United States." During the early 1950s, the United States Government tried to denaturalize and deport Matles on the basis that he had sworn falsely about his political affiliations when he had applied for American citizenship in 1934. In 1958, the case against Matles was thrown out by the United States Supreme Court for the reason that the Government was found to have unconstitutionally withheld documents from the defense at Matles's denaturalization trial.
