In the Name of the Volk presents the history of the Volksgerichtshof (VGH), the National Socialist People's Court, Hitler's chief attempt to revamp Germany's legal system. Founded in 1934, the court dealt with treason as the Nazis defined it. The book, written by H. W. Koch, who grew up under Nazism, focuses on the career of Roland Freisler, theoretician behind the court as well as its president from 1942 to 1945. Nazism, he believed, needed "organic" law ~ law that it could freely alter or stretch to meet problems as they arose. Freisler saw the court as a judiciary Fuhrer drawing on the real Fuhrer's mystical insight into the will of the Volk. All violations of that will ~ including treasonous intentions as well as acts ~ merited death. Guided by Freisler, the court redefined high treason to cover all political actions or speech it found distasteful, including the feeding of political prisoners and describing Hitler as a butcher. As Germany's war fortunes worsened, the court became occupied with "defeatists" and women having affairs with POWs. Its career reached a grand climax, however, in the trials stemming from the 20 July 1944 plot to kill Hitler. The judicial handling of this plot ~ the ultimate violation of the German people's will ~ is carefully and thoroughly treated in the book.
