It engages students through presentation of examples and analyses that build mastery of the material before moving on to more involved problems similar to those students will encounter on final examinations, bar examinations, and as lawyers. This new publication, like West's Learning Evidence, makes great use of problems to facilitate dialogue in class and correspondingly uses many fewer case excerpts than does the typical casebook. But it includes the core "canon" of civil procedure opinions as well as sufficient historical background necessary for producing culturally literate lawyers better equipped for actual real world litigation practice.
