Beginning with an overview of the jurisprudential and constitutional roots of whistleblower protection, the authors go on to outline the numerous legal remedies under both state and federal law available to whistleblowers. They demonstrate that although no comprehensive federal whistleblower laws exist, many laws and doctrines are sufficiently interrelated to offer a safety net of protection. Turning their attention to the private sector, the authors explain state court developments concerning liberalization of the traditional employment at will doctrine. They then analyze the case law of the twenty-six states that have adopted a public policy exception to the doctrine and the new tort created by this exception which offers additional protection by permitting suits for damages by private sector whistleblowers. An extensive appendix lists the texts of thirty federal whistleblower protection laws, an expecially valuable feature for practicing labor law attorneys.

About the Author

Stephen Martin Kohn is one of the leading whistleblower attorneys in the United States and is the Executive Director of the National Whistleblower Center. Since 1984 he has successfully represented numerous nationally recognized whistleblowers. He is regularly consulted by House and Senate leaders for help in drafting whistleblower protection laws. He is the author of several legal books on the subject.
 
Michael D. Kohn is a successfully represented whistleblowers in cases against some of the nation's largest corporations and law firms. He has also won numerous whistleblower cases against federal, state and local governments. His knowledge of issues involving the life sciences, nuclear energy and technology are integral to the firm's advocacy for those who report environmental violations in the workplace. He is co-founder and serves as President of the National Whistleblower Center, and Trustee of the National Whistleblowers Legal Defense & Education Fund. He formerly served as Legal Ethics Director at the Government Accountability Project (1985-88) specializing in litigating corporate whistleblower cases.
