FROM THE INTRODUCTION: It would not be difficult to find at least five headlines a week - or read or hear about half a dozen different cases of employment discrimination in the papers, magazines, or TVin the news, business, or feature coverage. Job-related bias, unfortunately, is big newsand big business. On an immediate level, you or your neighbor may be a victim of on-the-job "prejudice"; on a larger level, we are aware of others who are suing to get back their jobs, or realize some compensatory rewards for being unlawfully dismissed, refused employment, or denied a promotion. On a national level, we read about sexual harassment cases, or people who have lost their jobs because they are the wrong sex, age, color, or race, or wrong religionor wrong physically
Whatever the legal grounds underlying such cases, there is no denying that as we approach the end of the twentieth century, job discrimination claims are burgeoning, and society and the legal system, employees and employers alike, will have to confront the issues, the legalities, and the possibilities of major jury awards and settlements
The major reason I decided to write this book stems from the sure knowledge that there are hundreds of thousands of victims of employment discrimination - in all its nasty guises - who have not, or will not, challenge their termination, or denial of a promotion or other mistreatment by a current employer, or their inability to get a better job, because they don't realize they are protected from such actions by federal, state, and local lawsor because they are frightened to fight the "big guys"or because they feel they don't have the financial resources to engage in such a battle.
Job Discrimination II: How to Fight, How to Win lays out the parameters for combating the various forms of employment discrimination, with guidelines ranging from how to tell if you have a viable discrimination claim, all the way to waging your fight in court. I've included case histories of clients I've represented, as well as breakthrough suits that have made national headlines.
Aside from my major goal of providing an awareness of applicable laws and step-by-step information for pursuing a discrimination claim, I also hope to help restore an element that goes far beyond financial consideration. When a person loses a job, is denied a promotion, is sexually harassed, or is relegated to a lesser post because of age, sex, race, religion, ethnicity, or a physical handicap or illness, the emotional consequences often far exceed any financial losses.
The greater loss is that of self esteem. The feeling that "I can't take care of myself" or "I can't provide for my family" is drastic, devastating. What we lawyers describe as "emotional distress" must never be taken lightly. I hope that what follows in Job Discrimination II: How to Fight, How to Win not only provides a plan of action, but also shores up and reestablishes the sense of self-worth and pride that is so badly battered when one is a victim of employment discrimination.
