Synopsis

This book compiles and organizes case notes, articles, and papers written by well known and respected attorneys and professional consultants for original publication in a number of newsletters. Articles that do not include a specific byline were written by Kent Holland and first published in ConstructionRisk.com Report or in the International Risk Management Institute’s Expert Commentary (www.irmi.com). The cases and articles included in this book demonstrate risk management principles to be considered and applied on construction projects. The intent is to give a sampling of issues and cases, providing risk management ideas and information to serve as a useful resource for contractors, design professionals, project owners, attorneys, educators, risk managers, and insurance professionals. This book is based primarily on case notes published in Volumes 5, 6, and 7 between 2002 through 2005.

About the Author

J. Kent Holland is an attorney with the Virginia office of a nationally recognized law firm, with a legal practice emphasizing construction, government contracts, federal grants, and insurance law. He also provides risk management services for the environmental and design professional unit of a major insurance carrier From 1982 through 1986, he was an attorney in the Office of General Counsel of the U.S. Environmental Protection Agency, with responsibility for assisting the Agency in deciding wastewater treatment construction grants disputes, contractor claims, bid protests, and debarment matters. Mr. Holland is a frequent speaker on the subjects of environmental law, insurance law, and construction law, with a special emphasis on risk management for design professionals and contractors. He has written several books, including Risk Management & Contract Guide for Design Professionals (2006); Construction Law & Risk Management - Case Notes and Articles, (2003); Architectural/Engineering Contracts Risk Management Guide (1997); and EPA Construction Grants Disputes: Surviving the Audit (1990). He has also has written chapters in several manuals and books for publishers including, Wiley Law, Aspen Law, and International Risk Management Institute (IRMI). Mr. Holland publishes a web-based construction risk management library and legal newsletter at http://www.ConstructionRisk.com. He is a 1979 graduate of the Villanova University School of Law.
