Where upon the face of the answer there appeared a strong presumption of equity for the complainant, the Court continued the injunction to stay trial at law: as, where A. made a grant of past-fines to B. with covenant that he had power to grant, but B. was not to pay rent till peaceable possession. B. brings an action at law on the covenant of A's title or power to grant: A. prays to be relieved. The matter being confessed by answer to be as set forth by the complainant, the Court continued the injunction to stay trial. Where by the answer it appears to be matter of account that is in question, and the demand is very uncertain, the Court will commonly grant or continue an injunction. Injunction continued on exceptions to the answer, but the mere allegation of plaintiff that the answer is insufficient, is not ground to induce the Court to continue it.
