Synopsis

According to the Article 2 TEU is The European Union founded on the values of respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities. We have to respect and protect these values. The EU and member states are also bound by its Charter of Fundamental Rights, which sets out those rights that must be respected by them when implementing EU law. The Charter was solemnly proclaimed by Parliament, the Council and the Commission in Nice in 2000. After being amended, it was proclaimed again in 2007. However, only with the adoption of the Treaty of Lisbon on 1 December 2009 did the Charter come into direct effect, as provided by Article 6(1) TEU, thereby becoming a binding source of primary law. With the entry into force of the Treaty of Lisbon, the Charter of Fundamental Rights of the European Union became legally binding. The provisions of the Charter are primarily addressed to the EU institutions and then to the national authorities only when they are implementing EU law.The Court of Justice of the European Union (among others) interprets EU law to make sure it is applied in the same way in all EU countries and settles legal disputes between national governments and EU institutions. It has also the jurisdiction to interpret the Charter of Fundamental Rights of the European Union and the CJEU also uses this competence. In your hands (or in front of you on the screen) you have the collection of the relevant case law of the Court of Justice of the European Union with explanations according to official “Explanations relating to the Charter of Fundamental Rights.”
