Synopsis

Fighting Slander is a roadmap for defamation victims/targets who want to move on with their lives, ending the defamation, leaving behind bad memories and toxic people and the word “victim,” moving towards a brighter future with renewed optimism and their reputation restored.

The author looks at the simplest solutions first, from pretending to ignore it (not talking about it outside of friends and family), to a cease and desist letter (the cheapest legal solution), to erasing defamation from the internet with takedown notices to the website owners – only then does it move into a plain-English description of the legal options if a full lawsuit is necessary, with claims for economic damages and/or emotional distress.

It is also a condensed practice guide for attorneys and law firms who rarely see defamation cases, perhaps taking one on for a regular client, or because they are willing to fight the good fight. At 170 pages, Fighting Slander is thorough but digestible, in between the 10-page student guides meant to pass one exam and the 1,600 page practice guides that tell more than you want to know about defamation law.

About the Author

Nicholas Carroll has hired many law firms and also practiced law on his own behalf in real estate, publishing, and high tech startups. In 1991 he wrote the acclaimed book Dancing with Lawyers: How To Take Charge and Get Results, focused on helping clients get what they need from law firms. To promote that book he put up a website. Since birds gotta fly and writers gotta write, he kept adding short law-related articles to the website. The runaway hit was an article on defamation of character, which resulted in more email than he could answer, so in 2003 he decided to write a short book on defamation to answer all the readers' questions in one shot.

Fighting Slander promptly became an online hit. Unfortunately, readers peppered him with even more questions, resulting in three revisions of the book. Then both defamation victims and law firms started contacting him directly for consulting, with the first call coming from a defamation victim at 5 a.m. Half asleep, he agreeably said that he did consulting, adding ". . . but I'm not cheap." By evening he learned that in fact he was cheap, embarrassingly cheap, but kept his rates below those of brain surgeons and attorneys so that he could work directly for defamation victims as well as law firms.

After years as an expert witness in high-tension defamation lawsuits, Carroll is increasingly focused on defamation consulting for both victims and law firms, helping them thoughtfully weave the whole picture together before they take action, and will continue to do so until such time as he turns off his cell phone and moves to a mountaintop to meditate and master T'ai Chi.
