About the Author
Johannes Meiners studierte an der Universität Potsdam Rechtswissenschaften mit dem Schwerpunkt Rechtsphilosophie. Seit Abschluss des ersten juristischen Staatsexamens 2011 ist er als wissenschaftlicher Mitarbeiter einer Rechtsanwaltskanzlei im Bereich des öffentlichen Wirtschaftsrechts in Berlin tätig. Im Februar 2014 nahm er das Referendariat am Kammergericht Berlin auf, unter anderem mit Stationen beim Amtsgericht Berlin Mitte, der Staatsanwaltschaft Berlin und im Bundesministerium für Wirtschaft und Energie.

However, if one wants to grasp law as a normative phenomenon and not merely as a social mechanism for controlling behaviour, the question arises as to its power of obligation. This paper analyses the theories of Hans Kelsen, Jürgen Habermas and Niklas Luhmanns with regard to their epistemological starting points and their contribution to solving the problem of legal validity. The law and its validity cannot be adequately described without taking into account the participant's perspective: A justification of the validity of law as mandatory for the coexistence of people cannot be done statically, rather, it must always be reflected upon in its social context.; Warum sollte das positive Recht auch von denen befolgt werden, die ihm nicht zustimmen Die Geltung von Normen kann in der modernen Gesellschaft nicht mehr in Konstanten wie 'Religion', 'Natur' oder 'Konvention' verankert werden.
