Synopsis
洞穴探险者案是美国法理学家富勒于1949年发表的假想公案：五名探险者受困洞穴，为生存“不得不”分食其中一人，被抽签选中的是最初提出该建议、却在实施前反悔的威特莫尔。最终获救的四人以杀人罪被起诉，并被初审法庭判处绞刑。——他们是否犯有谋杀罪？富勒虚构了上诉法庭五位大法官的意见，将当时各个法哲学流派的观点纳入其中。1998年，萨伯续写了有关此案的九个新观点，又将20世纪法哲学的新发展引入讨论。
富勒的案例设计精巧，为论证的多向发展提供了可能，因此得以成为各种观点交战的场地。案例本身，连同虚构的法官陈词由此成为法学初学者探讨重要法律原则的必读文本，本书同时也作为激发思辨的优秀通识教育读本而备受推崇。
