Synopsis
En esta nueva obra de Jorge Luis Suárez Mejías, con prólogo de Allan Brewer-Carías, el autor estudia la relación entre el Mercosur y Venezuela partiendo de su “irregular ingreso” y las diferentes circunstancias que impiden la “verdadera incorporación” del país, visto que “luego de la destrucción y debacle que ha sufrido el mismo a lo largo del siglo XXI, con el modelo socialista implantado en Venezuela desde 1999 hasta el presente, lleno de controles públicos y ataques al derecho de propiedad y la libertad económica, (...) el Mercosur no es el verdadero espacio comercial para los venezolanos”.
Partiendo de esta idea, el autor divide su obra en cuatro capítulos a través de los cuales explica la integración como mecanismo particular de relaciones internacionales –y la supranacionalidad como su posible atributo– y la regulación de la integración en la Constitución venezolana de 1999; para luego adentrarse en la naturaleza jurídica, estructura institucional, funcionamiento y financiamiento del Mercado Común del Sur (Mercosur), la internalización de las normas del Mercosur en los Estados Parte según sus tratados y protocolos y la aplicación de las normas del Mercosur en Venezuela, distinguiendo entre el ser y el deber.
Todo lo cual permite al autor concluir –entre otros– que el “Gobierno venezolano (...) reafirma, junto con los argumentos basados en los tratados del Mercosur utilizados, que el Mercosur no es un proceso de integración supranacional”.
