- Book 3 of 4: The New York Co-op & Condo Handbook
Your board says the building is compliant. That is an answer about this year.
Local Law 97 charges New York buildings a penalty for every metric ton of emissions above their cap - every year they stay over. It is not a one-off fine. It recurs, and it grows.
Here is the part most boards have not modelled.
The first compliance period was set at levels that caught mainly the worst performers, so most buildings came in under and concluded they had no problem. The limits beginning in 2030 are dramatically tighter, and reporting suggests they will affect roughly three quarters of covered buildings - including many sitting comfortably under their cap today.
Only around a fifth of affected buildings are expected to meet the 2030 caps without significant work starting now. And that work - electrification, envelope, plant replacement - takes years to plan, fund and install. A board that waits until 2029 can end up paying penalties under two compliance periods at once.
For a co-op or condo the corporation or association is the responsible party, so the penalty is a building operating expense. It reaches you through maintenance or common charges. You did not choose the boiler. You will still pay for it.
- Whether your building is covered, and how the cap is actually worked out
- The three penalties - emissions, late filing, and false filing
- Why fuel oil, gas and grid electricity are not treated equally
- Reporting, the Registered Design Professional, and what to keep on file
- The good faith effort pathway, and what it is not
- What buildings actually do, in what order, and why sequencing matters
- Paying for it - reserves, assessment, refinancing and incentives
- What a violation with no plan does to your apartment's resale value
- A worked example, and the misconceptions that cost real money
- What to ask your board, and how to ask it without a fight
Twenty-one chapters in plain English, with a building compliance file checklist, a glossary, and template letters for owners, boards, engineers and buyers.
Every moveable figure carries a note explaining why it may have changed and exactly who to ask - because Local Law 97 guidance has been revised repeatedly since the law took effect.
Written by someone who has served on the boards that run apartment buildings since 2019, and who has written handbooks on shared-ownership housing for six other jurisdictions.
General information only. Not legal, engineering or financial advice.
