General Terms and Conditions (AGB)
§ 1 Validity of the GTC / Identity and address
- the customer accepts the following GTC for all present and future business relations. The GTC of the provider shall apply exclusively. Deviating, conflicting or supplementary general terms and conditions shall not become part of the contract, even if known, unless their validity is expressly agreed in writing.
2 All questions or complaints in connection with these General Terms and Conditions or the contracts on which they are based can be submitted to the provider in writing or by e-mail.
§ 2 Offer and conclusion of contract
-
the online presentation of our product range does not constitute a binding contractual offer. By sending us an order, the customer submits a binding offer. We reserve the right to freely decide whether to accept this offer.
-
orders shall be deemed to have been accepted when delivery and invoicing are made to the customer and/or when the order is confirmed to the customer in text form. If a customer's order is not accepted, the customer will be informed immediately.
§ 3 Right of cancellation/return
(In accordance with the German Distance Selling Act (FernAbsG) §3 and BGB § 355)
- the consumer is free to cancel the contract within 30 days without giving reasons or by returning the object of purchase. The cancellation period begins at the earliest upon receipt of these instructions. Timely dispatch of the cancellation or the object of purchase is sufficient to comply with the cancellation period.
To avoid misunderstandings or annoyances, please contact us by telephone or e-mail. A justification of the cancellation is not required, but will be gladly taken note of. - in the event of an effective cancellation, the services received by both parties are to be returned. If the service received cannot be returned in whole or in part or only in a deteriorated condition, the consumer must pay compensation for the value. In this respect, the consumer may only examine the goods carefully and diligently. The consumer must compensate for any loss in value resulting from excessive use, which means that the goods cannot be sold for more than the original selling price. Apart from the pre-existing right of cancellation, returns will not be accepted without the prior written consent of the supplier.
- if the consumer is already in possession of the goods, he is obliged to return them when exercising the right of cancellation if the goods can be sent by post. The consumer shall bear the costs of returning the goods when exercising the right of cancellation.
§ 4 Warranty/liability; customer's duty of inspection
-
the supplier deals with used/antiquarian books, sound carriers, films, etc., which may show signs of use due to their age, which are already appropriately reduced in the respective sales price. In this respect, the goods are supplied exclusively in the versions specified in our current online catalogue. All works offered in the catalogue are - unless stated otherwise - complete and generally in good condition according to their age. Minor defects in the state of preservation, such as stamps or names on title pages, minor damage to the binding and individual annotations or underlining, are generally not specifically indicated.
The buyer must inspect the goods immediately for completeness, transport damage, obvious defects, condition and their properties. Obvious defects must be reported to the seller in writing by the buyer without delay, at the latest within two weeks of delivery of the subject matter of the contract. -
if online information on the product range was incorrect, we will submit a counter-offer to the customer, who is free to decide whether to accept it. If it turns out that ordered goods are not available, we reserve the right to withdraw from the contract.
Furthermore, we are entitled to extend delivery periods in cases of force majeure. We will inform the customer of this immediately.
