Constitutional Regulation of Takings in Comparative Prospective

This book is a re-edition of the 2002 LL.M. thesis dealing with the Western legal experience of fettering the power of eminent domain and the reflective analysis of the Russian legal situation in this field. It deals with two Western countries, living under the rules of constitutional democracy (U.S. and France) which originate from different legal traditions (common and civil law), a post-soviet country with the emerging rule of constitutional democracy (Russia) and an international court (European Court of the Human Rights and Fundamental Freedoms), which exercises certain influence on the latter two countries (France and Russia).

Vadim Pak is a lawyer at the Registry of the European Court of Human Rights. He also co-teaches a course on human rights at Syracuse University.
