Construction Insurance begins with an introduction to basic insurance and related construction delivery concepts, and also discusses insurance-related contract drafting considerations. Six subsequent chapters discuss each of the basic insurance products typically used for construction, with an emphasis on their place in the construction context--commercial general liability insurance, builders' risk, professional liability insurance, and pollution insurance. A chapter is devoted to the related concepts of construction contract indemnities and additional insured coverage in commercial general liability (CGL) policies, and another covers performance bonds and contractor default insurance. In addition, the book offers valuable information on special insurance considerations, the "wrap-up" insurance model and how these programs work, and the insurance claims "process" in the course of construction. Finally, there is a detailed discussion of insurance coverage for delay-related damages under three types of insurance coverage and through performance bonds. In addition each chapter provides a list of resources for further reading. About the Author
Patrick J. Wielinski (Chapter 3) is a principal in the law firm of Cokinos Young in Dallas-Fort Worth, Texas. He practices in the areas of construction, insurance coverage, and risk management. Mr. Wielinski is past chair of the Insurance Law Section of the State Bar of Texas. He regularly lectures to construction, insurance, and legal groups on insurance coverage and risk management issues, including the Forum on the Construction Industry and the Insurance Coverage Litigation Committee of the Section of Litigation of the ABA. He is the author of Insurance for Defective Construction, 2nd edition and has authored numerous other publications for insurance, construction, and legal organizations. He is also the coauthor of Contractual Risk Transfer: Strategies for Contractual Indemnity and Insurance Provisions. Mr. Wielinski is a member of the AGC of America Surety Bonding and Construction Risk Management Committee and monitors the status of the law and the filing of amicus curiae briefs in cases involving insurance coverage affecting the construction industry.
Stephen D. Palley (Chapters 2 and 12) is a shareholder in the Construction Group of Ober Kaler in Washington, D.C. He specializes in insurance recovery litigation with a construction industry focus as well as complex construction defect litigation. A frequent speaker and author on construction insurance related topics, Mr. Palley also advises clients on the development and negotiation of insurance and risk-transfer programs for large construction projects throughout the United States, including power plants, airports, sports venues, and hospitals. He received his B.A., cum laude, from Tufts University and his J.D. from the Washington University School of Law in St. Louis.
