Designed for use in an upper-level environmental law course, or as a supplement in the basic environmental law course, this book develops the knowledge and skills a lawyer will need to practice in the environmental law field. The book is organized around the types of environmental practice: compliance, enforcement, litigation, policy, and permitting. It places readers in the three key roles played by environmental lawyers―government attorney, corporate counsel, and public interest advocate―and provides practice pointers for each of these types of work. Students will explore the major environmental regulatory areas through problems and exercises that foster a deeper understanding of the substantive law while honing the skills necessary for successful practice. The expertise gained in administrative law practice should allow students to successfully navigate a wide range of highly-regulated fields.
This book contains problems in the major substantive environmental law areas such as the Clean Air Act, Clean Water Act, CERCLA, RCRA, EPCRA, NEPA, and citizen suits. The fifth edition includes material incorporating recent Supreme Court decisions such as Sackett, Loper Bright Enterprises, and SEC v. Jarkesy, as well as the latest statutory and regulatory changes. The book can be used as the main text in an upper-level environmental law practice course or as a supplement in the foundational course. It has also been frequently used in environmental law clinics to help students quickly gain the research tools and fundamental procedural knowledge necessary to successfully practice.
Of the many books on environmental law, Environmental Law Practice is the one to use to develop the skills to become a practice-ready environmental attorney.
