Henry Newland argues that, from the time when parochial tithe was established in England, there is no statute or canon law that sanctions a fourfold division of tithe, or the allocation of a quarter to the poor or to church repairs. He contends that the canon law of England, and the common law of England and Ireland, recognized the parochial right to tithe in full to the parish minister and did not permit a mandated quadripartite distribution. Drawing on Legatine Constitutions (Otho and Othobon), provincial synods at Oxford and Merton, Lyndwood, Athona, and Blackstone, Newland reconstructs the historical practice across the thirteenth to fifteenth centuries. He argues that any appearance of a fourfold division derives from misinterpretation of monastic endowments and from later legends, not from enduring legal enactment. He shows that pre-Reformation rules, which regulated repairs of churches and maintenance of the poor, envisioned distributions by the rector or bishop, without a fixed quarto part for the poor. The work challenges Dr Doyle’s assertions, urging reliance on English canon and civil law as the appropriate standard for England and Ireland.
