Within the past decade a lively debate has developed over how judges should interpret the Constitution. Wellington, a prominent legal scholar, analyzes the process by which judges normally interpret legal texts and employs this analysis as the basis for critiquing various interpretive approaches, such as a reliance on the original intent of the Founders. In defending the Roe v. Wade abortion decision, which involved the Supreme Court's recognition of a constitutional right to privacy, he relies heavily on what he terms "public morality," that is, reasoning from premises found in the moral perceptions of the general populace. His introduction to the debate over constitutional interpretation will be heavy going for the general reader but of considerable interest for those with some background in the law.
